The Services are intended for individuals aged 17 and older. By using the Services, you represent that you meet this requirement and have the legal capacity to enter into these Terms.
2) The Services
Discover the secrets of nature with Cippo! Snap a photo or upload an image to identify flowers and plants while uncovering fascinating details about their characteristics. Save your discoveries in personalized collections and track your exploration journey.
We may add, modify, or remove features at any time.
3) Accounts
To use certain features, you may need to create an account and provide information such as your name, username, and email address.
- Keep credentials secure: you are responsible for maintaining the confidentiality of your login details.
- Accurate info: you agree to provide accurate information and keep it up to date.
- Account activity: you are responsible for all activity under your account.
4) User Content
"User Content" means content you submit through the Services (for example, photos/images you upload for identification, text you provide, and messages to customer support).
You retain ownership of your User Content. You grant Cippo a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, and display your User Content solely as necessary to operate, maintain, and improve the Services and provide support.
You agree not to submit User Content that is unlawful, harmful, harassing, defamatory, obscene, infringes rights, contains malware, or interferes with the Services.
5) Optional AI-assisted features (if enabled)
The Services may use automated image and/or text analysis (including machine-learning techniques) to generate identification results and related details when you upload an image or enter text.
By choosing to use these features, you authorize us to process the content you upload for the purpose of generating the output you request. You control whether you upload content and whether you generate results.
6) Acceptable use
- Do not reverse engineer, decompile, or attempt to extract source code except where prohibited by law.
- Do not access or use the Services in a way that could disable, overburden, damage, or impair the Services.
- Do not use the Services to violate any law or regulation.
- Do not attempt to gain unauthorized access to accounts or systems.
- Do not interfere with or disrupt the integrity or performance of the Services.
7) Intellectual property
The Services (including software, design, text, graphics, trademarks, and logos) are owned by Cippo or its licensors and are protected by applicable laws. Except for the limited license granted to you, we reserve all rights.
8) License to you
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App for your personal, non-commercial use on compatible devices you own or control.
9) Third-party services
The Services may rely on or interact with third-party services (for example, platform services provided by Apple, network providers, or operating systems). We are not responsible for third-party services outside our control.
10) Disclaimer of warranties
The Services are provided "as is" and "as available."
To the maximum extent permitted by law, Cippo disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Plant identification results may be incorrect or incomplete and are provided for informational purposes only. Do not rely on the Services as the sole basis for decisions involving safety, health, allergies, toxicity, or consumption.
11) Limitation of liability
To the maximum extent permitted by law, Cippo will not be liable for indirect or consequential damages.
To the maximum extent permitted by law, Cippo's total liability for all claims relating to the Services will not exceed the amount you paid to Cippo for the Services in the 12 months before the event giving rise to the claim, or USD $50 if you paid nothing.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
12) Indemnification
You agree to indemnify and hold harmless Cippo and its team members from claims arising from your use of the Services, your User Content, or your violation of these Terms.
13) Termination
You may stop using the Services at any time. We may suspend or terminate access if we reasonably believe you violated these Terms or to protect the Services or other users.
Upon termination, the license granted to you ends.
14) Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will provide notice within the App or by other reasonable means. Continued use after the effective date constitutes acceptance.
15) Governing law; binding arbitration
These Terms are governed by the laws of the principal place of business of Cippo Team, excluding conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Services will be resolved by binding arbitration, and not in court, except that either party may seek injunctive or equitable relief to protect intellectual property rights or prevent unauthorized access or misuse.
Arbitration will be conducted on an individual basis. Class actions are not permitted to the extent allowed by law.
